What is the process to transfer complete property rights with least expenses?
Question asked by Mr. Upendr Nath from Bangalore, India:
Hi, I purchased two residential plots in Bangalore in 2004 and 2007 for my son in law who is in Mumbai, one near Anekal and other near Devanahalli, for which money was given by him. However as he could not come here for registration, he suggested to get the plots registered on my name which can be transferred to him later. Now I wish to transfer the property back to him in least expensive way as I already spent good amount for registration earlier. He purchased the plots as long term investment. please advise 1)best way to transfer full property rights with least expense 2)whether a single instrument can be made for both sites 3)since the sites are located at different places, where can I register such transfer deed.4) please suggest a lawyer who can do this service.
Thanks
Upendr Nath
Vatsala Answers:
You can transfer it to your daughter and she can in turn gift it to her husband. You have to execute two gift deeds for each plot because the jurisdiction of the sub registrar is different. If any person cannot be physically present for registration, a power of attorney can be executed and the power of attorney holder can then get the deed registered in the absent person’s name.
