Can Someone Be Appointed To Buy A Property on A Person’s Behalf?

Dear Vatsala,This is to say that I am working in Canada for more than 9 months on a work permit status. Now I am planning to buy a plot in Madhya Pradesh (M.P) in India for the residential purpose. Since I don’t want to go to India for a mere purchase of the plot. Therefore, I want to know if someone can purchase the plot on behalf of me; and what all process I will have to go through. Also, I want to know how much time it will take for the whole process. And most important but now least, Is this kind of dealing will be safe for me?

You should appoint a reputed local advocate directly by communicating to him or her. Then you should get the land papers whetted by such person and get a title certificate. You can also find out if you need to insert a public notice or not. You should inspect the original documents to rule out prior mortgages. After being satisfied with the title, you can execute a power of attorney in Canada, get it notarized and sent to India. It should be stamped in India with proper stamp duty on its arrival and then the person you have appointed can purchase the property on your name by representing you in the concerned sub registrar’s office.Vatsala
