Is there a legal way to sort out the issue of illegal increase of the maintenance charges?

Question asked by Mr. Rajasekaran from India:
Hi, I am residing in a society contains 67 flats. The flat contains 1br, 3br and range from 400 sq ft to 1100sq ft till date the maintenance charges were Rs.600/- (equal to all) and 6 months back the association raised the charges to Rs.750/- (equal to all). Again it has raised the maintenance to Rs.900/- (equal to all). We the 1br flat owners (12 nos) want to fight out the maintenance charges on sq ft basis since further increase is injustice to the 1br flat owners.
But overall (12 out of 67 flats) we are not the majority, still the charges are illegal. Kindly let me know is there any legal way to sort out this issue.

In the absence of a majority vote you can try to sort out the matter through arbitration or by filing a case. However the opposite side also has good merit in their case because of duly passed resolutions in meetings with majority vote. So you have to take your chances and see.
