What options can one seek for if a builder denies to pay the compensation for delay in delivery?
Question asked by Ganesh from Bangalore:
Dear Vatsala,
My name is Ganesh. I have booked at apartment at Prestige Shantiniketan in Bangalore. The delivery of the apartment was initially scheduled for April 2008 as per the original Sale agreement. Prestige sent us an amendment to the agreement sometime in 2007 notifying us that the apartment delivery would be delayed until December 2008. In August of 2008, Prestige informed us that the delivery would be sometime in April – May of 2009. The deliveries would be in phases extending up to November of 2009. The Sale agreement says that Prestige will be paying us the compensation for any delay in delivery. It now looks like Prestige will not be honoring that statement anymore. They have rejected our request for compensation.
What are our options and what should be our approach at this time?
Please advice.
Thanks and Warm Regards
Ganesh

You have to approach the consumer court for deficiency in service and produce adequate support for your case. In my opinion it has merit. Vatsala
