What is the best way to register the part of the property in one’s name, if the property is jointly constructed?
Question asked by Mr. Vivek from USA:
Hello Vatsala,
This is Vivek from USA. I had a question regarding property registration in Bangalore city. One of my relative has a property in Bangalore. We are jointly constructing the house.
a. what is the best way to register the part of the property in my name?
b. If a building is half constructed, can such property be registered?
Thanks in advance,
Regards,
Vivek
Vatsala Answers:
If there are no restrictive covenants in the parent sale deed, you can purchase undivided 50% share in the land and become the joint owner. This can be registered even if the building is half constructed. However the specific share in the building to be constructed should also be shown in the deed so that title to each portion can be separate and Khata transfer can be separately issued. This drafting of the sale deed has to be handled with care and caution.Vatsala
